Terms

Terms of service

The terms on which Fynesia, the website and the application, are made available. Short, because they say what we actually do.

Who we are, and what these terms cover

Fynesia is published by CodeCubica sp. z o.o., ul. Długa 29, 00-238 Warszawa, Poland (KRS 0001160679). Contact: hello@fynesia.com.

These terms apply to the fynesia.com website and to the Fynesia application: the web app, the desktop app and the companion app. By using either, you accept them. Where your firm has signed an agreement with us, that agreement prevails over these terms if the two differ.

Your account

Access is opened by us, firm by firm, for a pilot or under a subscription. Your account is personal: keep your sign-in details to yourself, and tell us at once at hello@fynesia.com if you think someone else has used them.

You must be authorised to connect the mailboxes, calendars, documents and chat accounts you connect, and to let colleagues see what you choose to share.

What Fynesia does, and does not

Fynesia brings your emails, messages, calendars, documents and recorded meetings into one workspace, builds your contacts and deals from them, and answers your questions from your own data, citing where each answer came from.

The assistant can be wrong. Its answers, summaries and drafts are a help, not advice: check them before you act on them, and nothing it prepares is sent without an action from you. Fynesia is not financial, legal or investment advice.

Features change as we build. We may add, improve or withdraw features; a withdrawal that matters to your work is announced to your firm in advance.

Connected accounts

You connect a third-party account through that provider’s own permission screen, and you can revoke the permission at any time, there or in Fynesia’s settings. The provider’s terms continue to apply to your use of its service.

Fynesia’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. How we handle connected data, Google’s included, is set out in the Privacy policy.

Acceptable use

Use Fynesia lawfully and for your firm’s own business. Do not use it to send unsolicited mail, or anything that breaks the law or the rights of its recipients: you are responsible for the messages and campaigns you send.

Recording a meeting is your responsibility: obtain the consent that the law where you are requires from the people in it.

Do not probe, bypass or overload the service’s security, do not reverse-engineer it, and do not resell access or make it available outside your firm.

Your data

What you connect and what you create in Fynesia stays yours. You grant us only the licence needed to host, index, display and process it in order to provide the service to you, as described in the Privacy policy.

We never use your data to train a model, ours or anyone else’s. We never sell it. Removing a mailbox together with its indexed emails deletes them from Fynesia; when you or your firm leave, everything held for you is deleted on request, and you can ask for an export first.

Our intellectual property

Fynesia, its name, logo, software, interface and documentation are the property of CodeCubica sp. z o.o. You receive a limited, non-exclusive, non-transferable right to use the service for the duration of your pilot or subscription, and nothing more.

Suggestions you send us may be used freely to improve the product.

Pilots, fees and ending

Pilots run on the terms agreed in writing when they start. Subscriptions are billed per seat, at the price and for the term agreed with your firm.

Your firm can end its use as its agreement provides. We may suspend an account that breaks these terms or puts the service or other firms at risk, telling you beforehand when we can.

Availability

We work to keep Fynesia available at all times, but cannot promise it will never be interrupted: maintenance, faults and the providers you connect are all beyond that promise. Planned maintenance is announced in advance.

Liability

Fynesia is provided as it is, with the care you would expect from us but without a guarantee that it is free of errors. To the extent the law allows, our liability for any loss arising from your use of Fynesia is limited to the fees your firm paid us in the twelve months before the event, and we are not liable for indirect loss, including lost profit, lost deals or lost data that you could have backed up.

Nothing here limits a liability that the law does not allow to be limited.

Changes to these terms

When these terms change, the new version is published here with its date. A change that reduces your rights is announced to your firm before it takes effect. Continuing to use Fynesia after that date is acceptance of the new terms.

Law and disputes

These terms are governed by Polish law. Any dispute we cannot settle between us falls under the jurisdiction of the competent Polish courts. If you use Fynesia as a consumer in the European Union, the mandatory protections of your country still apply.
